Terms and conditions of use Digital Spark™ hereinafter referred to as "Platform") is a licensed software solution of Softech integration S.L. (hereinafter referred to as "Licensor"), under the trademark Digital Spark™ intended for sellers and managers in retail outlets that sell items from assortment of the company that use software. 

Please read these Rules carefully before accessing or using the platform. General rules By accessing and using the Platform, you declare that you have read, understood and accept the stated Rules, as well as that you agree to the collection and processing of personal data for the proper use of the Platform, thus establishing a contractual relationship between you and the Platform. 

Previous contracts, agreements or arrangements of any kind between the two parties. By registering a user and clicking on "I accept the Terms and Conditions of Use" you agree to these Terms and Conditions and accept them. Any behavior that is contrary to the stated rules will be sanctioned by denying access or deleting the profile. If you do not agree with the Terms and Conditions at any time, you can delete your profile or stop using the Platform. 

The platform is free to use for all users. When using the Platform, users must adhere to the following: 

  • Use only correct data when creating profiles; 
  • Create one personal profile within the retail facility where you work; 
  • Do not create fake profiles and profiles of non-existent persons; 
  • Carefully manage your profile access data. It is strictly forbidden: 
  • Impersonation and / or creation of fraudulent orders; 
  • False reporting of sold products; 
  • Ordering prizes without sales of products; 
  • Illegal collection of points; 
  • Sell, copy, distribute, offer, rent or otherwise commercially exploit data within the Platform; 
  • Publishing offensive and inappropriate content; 
  • Publishing false information; 
  • Disclosure of information with the aim of damaging the personal reputation or the reputation of any company. 

You are responsible for storing your password on your profile. Do not share access data for your profile with anyone. You are responsible for everything that happens through your profile unless you report the abuse in a timely manner. Each user of the Platform is obliged to put true information on the Profile and not to publish content that violates the any laws, anyone's rights, including intellectual property rights. 

By accepting these Terms and Conditions and using the Platform, you agree that through our Platform you can be sent notifications and messages to the contact information you left during registration and profile creation (e-mail, contact, phone). 

If your information is out of date or invalid, you may miss important notices. By accepting these Terms and Conditions as well as using the Platform, you confirm the accuracy and validity of the contact information you have provided. 

By accepting these Rules, you also agree that all your data resulting from the activities on the Platform are kept in records and used for statistical calculations that can be made public. The Platform reserves the right to unilaterally change the Rules, suspend the provision of services or any part thereof, at any time and for any reason. 

By accepting the Rules, you agree that there may be Terms and Conditions of Use of "third parties" whose acceptance is also necessary for the use of the Platform. Therefore, you agree that such use of the Services and Systems may be subject to the Terms of Use and Privacy Policy to be determined by third parties. In this case, the Platform cannot and will not be responsible for any product or service provided by third parties. 

Please note that "third parties" within the meaning of these Rules will be considered Apple Inc., Google Inc., Huawei Gallery App, if you use the Services through developed mobile applications for Apple OS and Android. These third parties are not signatories to these Rules and are not responsible for providing the Services or supporting the Platform in any way. 

By accepting these Terms, you agree that you will indemnify the Platform for all damages, including the costs of attorney and bailiff services, as well as the costs of court proceedings, which may result from: a) Your use of the Services outside the established rules; b) by violating any provision of these Terms; c) misuse of confidential information; d) by violating the rights of any third party. Disclaimer The Platform is not responsible for indirect, incidental, punitive or consequential damages (eg lost profits, loss of data, injuries, material damage) that may occur during or in connection with use. 

By accepting this document, you waive your right to claim benefits arising from your use of this platform. The Platform will also not be liable for damages incurred: a) due to the current inability to use the Services if the inability is due to your error; b) due to delays or omissions in the provision of services, c) if the omissions are caused by force majeure or unpredictable circumstances. 

The Platform will not be responsible for unauthorized use of personal data of the user, public disclosure and / or misuse of the same by third parties, which came to the same without the knowledge and authority of the Platform. The restrictions stated in this section of the Rules are not intended to exclude or change your rights as a consumer guaranteed by the legal system of the country where the software is used. 

Changes to the Terms and conditions 

The platform reserves the right to change and adjust the Terms and Conditions. If there is a change in the Terms and Conditions, users will be notified in a timely manner of changes through system messages before the changes take effect. If you do not accept the changes in the Terms and Conditions, you can delete your profile. Continuing to use the Platform after you have been notified of the changes will be considered consent to the changed Terms and Conditions. Personality data management Use of the Platform by users is voluntary. For the process of user registration, personal data are required, such as name and surname, e-mail address, telephone number and other personal data necessary for the operation of the Platform, in accordance with applicable legislation in this area. 

It will not be possible to start using the Platform without leaving the specified information in the registration process. The submitted information and data will be used in the verification of users and the creation of user profiles. The Platform will process the data of users submitted during the registration in order to use the Platform legally, fairly and transparently, in accordance with the positive legislation of GDPR regulations, in order to provide services to the Platform. 

By accepting these Terms and Conditions, you agree that the Platform has the right to collect and process your personal data and other data for the purposes of providing the Platform's services, in accordance with applicable regulations.

The user and the visitor can withdraw this consent at any time by sending an email to support@softech.es. If the user or visitor withdraws the consent, the Platform will delete the user's data. All personal data of users who have withdrawn their consent to the collection and processing of data, as well as data of other users after the termination of the Platform will be deleted as soon as possible. 

By downloading the application, you agree to install and update enhanced versions of our software and additional features to enhance, enhance your user experience. 

The platform reserves the right to delete profiles of users who violate the Terms and Conditions or do not comply with them. Each user has the opportunity to report inappropriate use of the Platform by other users to the e-mail address support@softech.es. 

The company Softech integration S.L., based in Madrid, Spain with its headquarters in Paseo Recoletos 5, 28009 Madrid, has the status of Data Controller. The personal data processing manager employed by the Data Controller is Petar Jovovic, dpo@softech.es.
